1. Agreement to Terms
By accessing, registering an account, or using the Venda Eats platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these Terms, you must discontinue use of the Platform immediately.
By creating an account, you also consent to receive essential service-related communications, including but not limited to:
- Account verification emails
- Password reset emails
- Order confirmations and updates
- Delivery status notifications
- Security alerts
- Important account notifications
These communications are necessary for operating your account and cannot be opted out of while your account remains active.
2. Intellectual Property Rights
Unless otherwise stated, all content available on the Venda Eats Platform — including but not limited to software, source code, databases, website design, mobile applications, logos, trademarks, graphics, text, images, icons, and branding — is owned by or licensed to Venda Eats.
No content may be copied, reproduced, distributed, modified, republished, or exploited without prior written permission from Venda Eats.
3. User Representations
By using or registering on the Platform, you represent and warrant that:
- All registration information is accurate, complete, and up to date.
- You will maintain the accuracy of your account information.
- You have legal capacity to enter into this agreement.
- You are at least 18 years old or have the consent of a parent or legal guardian where permitted by law.
- You will not use automated software, bots, scripts, or similar technologies to access the Platform.
- You will use Venda Eats only for lawful purposes.
- You will not misuse the Platform or interfere with its normal operation.
4. Prohibited Activities
You agree not to:
- Use the Platform for unlawful or fraudulent purposes.
- Submit false or fraudulent orders.
- Impersonate another person or business.
- Interfere with Platform security or infrastructure.
- Reverse engineer or modify any part of the Platform.
- Access information that does not belong to you.
- Harass, threaten, abuse, or discriminate against customers, vendors, drivers, or staff.
- Upload malicious software or harmful code.
- Circumvent payment systems or fees.
Venda Eats reserves the right to suspend or permanently terminate accounts that violate these Terms.
5. Vendor and Driver Responsibilities
Vendors
Vendors using Venda Eats agree to:
- Maintain all required business licences and permits.
- Ensure food complies with applicable South African health regulations.
- Prepare orders accurately and within reasonable timeframes.
- Keep menu prices and availability up to date.
- Honour accepted orders unless cancellation is unavoidable.
Drivers
Drivers agree to:
- Hold a valid South African driver's licence where required.
- Maintain appropriate insurance where applicable.
- Deliver orders safely and professionally.
- Follow all road traffic laws.
- Handle food carefully to maintain quality and hygiene.
- Provide accurate delivery status updates.
Venda Eats acts solely as a technology platform connecting customers, vendors, and delivery partners.
6. Payments
Payments may be made through approved payment methods offered on the Platform, including debit cards, credit cards, digital payment providers, or Cash on Delivery (where available).
Payment processing is handled by secure third-party payment providers.
Venda Eats does not store customers' full payment card details.
7. Refunds and Cancellations
Refunds and cancellations are subject to our Refund Policy.
Refund requests may be approved where:
- An order was not delivered.
- Incorrect items were delivered.
- Food arrived spoiled or unsafe.
- Payment was processed incorrectly.
Refund eligibility is determined after investigation by Venda Eats.
8. South African Law Compliance
Venda Eats complies with applicable South African legislation, including:
- Protection of Personal Information Act (POPIA)
- Consumer Protection Act (CPA)
- Electronic Communications and Transactions Act (ECTA)
- Cybercrimes Act
9. Limitation of Liability
To the fullest extent permitted by law, Venda Eats, its owners, employees, contractors, vendors, delivery partners, and affiliates shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from the use of the Platform.
Venda Eats does not guarantee:
- Continuous Platform availability.
- Exact delivery times.
- Availability of menu items.
- Accuracy of information provided by vendors.
- Performance of third-party services.
Customers acknowledge that food quality remains the responsibility of the vendor.
10. Account Suspension
Venda Eats may suspend or permanently terminate accounts where users:
- Commit fraud
- Abuse staff or drivers
- Repeatedly submit false orders
- Violate these Terms
- Engage in illegal activity
11. Changes to These Terms
Venda Eats may update these Terms at any time. Changes become effective immediately upon publication. Continued use of the Platform constitutes acceptance of the updated Terms.
